1. About these terms
These terms are an agreement between you and Dean Longstaff, an individual developer trading as Binminder ("we", "us"). They apply when you download or use the Binminder app or this website.
Binminder is made by one person rather than a company. That does not change your rights under these terms or in law, but it is worth knowing who you are dealing with: support is answered by the person who wrote the app.
By using Binminder you accept these terms. If you do not accept them, do not use the app. How we handle personal data is set out separately in our privacy policy, which forms part of this agreement.
Nothing in these terms affects your statutory rights as a consumer, which cannot be excluded or limited by agreement.
2. App store terms
Binminder is distributed through the Apple App Store and Google Play, and their terms apply alongside these ones.
Apple. Your licence to use the iOS app is granted under Apple's Licensed Application End User Licence Agreement, except where these terms say otherwise. This agreement is between you and us, not with Apple: Apple is not responsible for the app or its content, and has no obligation to provide support or handle any claim about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Google. Use of the Android app is also subject to the Google Play Terms of Service. This agreement is between you and us, not with Google.
3. What Binminder does
Binminder finds the organisation that collects waste at an address you give it, retrieves the collection dates that organisation publishes, and schedules reminders on your device. It supports a large number of councils, municipalities and waste providers, but not every one, and coverage changes over time.
Reminders are scheduled by your device's operating system. Whether and when they appear depends on your device settings, notification permissions, battery optimisation and Do Not Disturb — things we do not control.
4. Accuracy of collection dates
Binminder reports what your council or waste provider publishes. We do not set collection dates, and we cannot guarantee they are correct, current, or that collection will happen as scheduled.
Dates can be wrong or missing for reasons outside our control, including:
- the provider publishing incorrect, delayed or incomplete information;
- changes around public holidays, strikes, severe weather or other disruption that are not published in the data we receive;
- the provider's website or system being unavailable, in which case the app shows your last known schedule and labels it as such;
- an address being matched to the wrong provider or property.
Binminder is a convenience, not a guarantee. For anything that matters — a missed collection, a bulky waste booking, a change of service — check with your provider directly. We are not liable for a missed collection, and we do not accept responsibility for fines, charges or penalties imposed by a provider or authority.
5. Your responsibilities
- Enter an address you are entitled to look up — your own property, or one you are responsible for.
- Keep your device's notification settings in a state where reminders can actually reach you, if you want them to.
- Check important collection information with your provider rather than relying on the app alone.
6. Subscriptions and payment
Access to the main app requires a paid subscription. Prices, billing periods and any free trial are shown in the app before you buy, and in your app store.
- Payment. Purchases are processed by Apple or Google as merchant of record and charged to your app store account. We never receive your payment details.
- Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the period ending.
- Free trials. Where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited if you buy a subscription during the trial.
- Price changes. If we change the price of a subscription, we will give you notice and your app store will ask for your consent before the new price applies. You can cancel instead.
7. Cancelling and refunds
Cancel at any time in the Subscriptions section of your Apple App Store or Google Play account. Cancellation stops the next renewal; you keep access until the end of the period you have paid for. Deleting the app does not cancel a subscription.
Refunds are handled by the store you bought from, under its refund policy — we cannot issue refunds for app store purchases directly. Apple: reportaproblem.apple.com. Google: Google Play refund request.
Consumers in the UK and EU. You normally have 14 days to withdraw from a distance contract for digital content. Where you asked for immediate access and acknowledged that you lose that right once supply begins, the right ends at that point. This does not affect your statutory rights if the service is faulty, not as described, or not supplied with reasonable care and skill. Contact us or your app store if you think that applies.
8. Acceptable use
You agree not to:
- use the app or our data service in a way that places an unreasonable load on it, or on any council or provider system it reaches — including automated scraping, bulk querying or circumventing rate limits;
- reverse engineer, decompile or attempt to extract credentials or keys from the app, except where law expressly permits it;
- resell, redistribute or commercially exploit the collection data the app retrieves;
- use the app for anything unlawful, or to interfere with anyone else's use.
We may rate limit, suspend or block access where we reasonably believe this section is being breached.
9. Intellectual property
We own the Binminder app, this website, the name and the branding, or licence them. You get a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use.
Collection data belongs to the councils and waste providers that publish it, and is subject to their terms. Binminder's data service is built on open-source components under their own licences; the notices are published with our source.
10. Availability and changes
We aim to keep Binminder available but do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features, add or remove supported providers, or stop offering the app. Where a change materially reduces what you have paid for, we will tell you and you may cancel and seek a proportionate refund from your app store.
We may update these terms — to reflect a change in the service or the law, for example. We will change the date at the top of this page, and tell you in the app before a significant change takes effect. Continuing to use Binminder afterwards means you accept the updated terms.
11. Ending this agreement
You can end this agreement at any time by cancelling any subscription and deleting the app. We may end it, or suspend your access, if you materially breach these terms — in particular section 8 — or if we stop offering the service.
12. Our liability to you
Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or anything else that cannot lawfully be excluded or limited — including, for consumers, your rights under the Consumer Rights Act 2015 or equivalent legislation where you live.
Subject to that:
- We provide Binminder to consumers for domestic and private use. We are not liable for business losses — loss of profit, business, contracts or opportunity.
- We are not liable for loss or damage that was not foreseeable at the time this agreement was made.
- We are not liable for missed collections, or for fines, charges or penalties imposed by a council, provider or authority, where these result from collection information published by a third party being wrong, late or unavailable, or from reminders not appearing due to your device's settings.
- Where liability can lawfully be capped, our total liability arising out of this agreement is limited to the greater of the amount you paid us in the 12 months before the claim, or £50.
13. Governing law
These terms are governed by the law of England and Wales, and its courts have jurisdiction over any dispute. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your local law, and may be able to bring proceedings in your own country's courts.
